Terms of Service.

These Terms of Service (“Terms”) govern your access to and use of the Wabi mobile application (“Wabi”, the “App”). By creating an account or using the App, you agree to these Terms. If you do not agree, do not use the App.

1. Eligibility

You must be at least 13 years old to use Wabi. By using the App, you represent that you meet this requirement and that you have the legal capacity to enter into these Terms.

2. Your Account

You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us promptly if you suspect unauthorized use of your account.

3. Your Content

You retain ownership of the ratings, notes, photos, and other content you submit to the App (“User Content”). By submitting User Content, you grant Wabi a non-exclusive, worldwide, royalty-free license to host, store, reproduce, and display that content within the App, including to other users as part of feeds, profiles, friend activity, and leaderboards. You represent that you have the rights necessary to grant this license and that your User Content does not violate any law or the rights of any third party.

4. Acceptable Use

You agree not to:

• Submit User Content that is unlawful, abusive, harassing, defamatory, or infringes the rights of others;
• Impersonate any person or entity, or misrepresent your affiliation with any person or entity;
• Attempt to manipulate points, tiers, streaks, or leaderboard rankings other than through normal use of the App;
• Reverse engineer, decompile, scrape, or attempt to gain unauthorized access to the App or its underlying systems.

We may remove User Content or suspend or terminate accounts that violate these Terms.

5. Account Deletion

You may delete your account at any time from Settings > Delete Account. This permanently removes your profile, activity logs, photos, points, friendships, and notifications from our systems. This action is immediate and cannot be undone.

6. Intellectual Property

The App, including its design, branding, and underlying software, is owned by Wabi and protected by intellectual property laws. Except for the limited license to use the App for its intended purpose, these Terms do not grant you any rights to our trademarks, logos, or other intellectual property.

7. Third-Party Services

The App displays cafe information sourced in part from the Google Places API. This information is provided by third parties and may be incomplete, outdated, or inaccurate. Wabi is not responsible for the accuracy of third-party content.

8. Disclaimer of Warranties

The App is provided on an “as is” and “as available” basis, without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be uninterrupted, secure, or error-free.

9. Limitation of Liability

To the fullest extent permitted by law, Wabi and its founders will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, arising from your use of, or inability to use, the App.

10. Termination

We may suspend or terminate your access to the App at any time, with or without notice, for conduct that we believe violates these Terms or is otherwise harmful to other users or to Wabi.

11. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will update the “Last updated” date above and, where appropriate, notify you within the App. Continued use of the App after a change takes effect constitutes acceptance of the revised Terms.

12. Governing Law

These Terms are governed by the laws of the State of New York, United States, without regard to its conflict of law principles.
